Top 10 Films of 2008

Now I have to confess I have managed to miss a number of films such as Wall-E that i should have seen, but of what I did see, these were the best (and most came out at the beginning of the year and were Oscar nominated)

1. There Will be Blood - Seeing this at the Cinema was an assault on the senses. Oppressive score, barnstorming performance by Day Lewis. Outstanding cinematography. [Ok, yes, I’ll admit it was not to happiest film, and you could argue that the lack of any really pleasant character makes it a hard film to love]
2. The Assassination of Jesse James by the Coward Robert Ford - Another long, beautifully shot, film. Once again a great score and great central performances, and a fascinating story.
3. Juno - I’m not sure I’d trust someone who didn’t like this film. If nothing else the scene stealing performances by Alison Janey and J.K. Simmons (also the best thing in Burn Before Reading) are a delight.
4. No Country for Old Men - Yes, it is violent, and yes the ending is a bit odd (but then, it is in the book), but this was a great ride.
5. Charlie Wilson’s War - I’m not Tom Hanks’ greatest fan, but he was excellent in this enjoyable romp, unbelievably based in truth. Indeed it was just a shame for Tom that Philip Seymour Hoffman was also in the film doing yet another stellar start turn performance.
6. Gone Baby Gone - Very impressive directorial debut for Ben Affleck, with a fine performance from his younger brother Casey.
7. The Orphanage - Spooky.
8. Iron Man - Total tosh, but tosh of the highest calibre.
9. The Dark Knight - God did this feel go on and on or what? Edit out the boat scene and re-release please. That aside, I thought this built quite well on the first film (which is still much much better) although Christian Bale’s whole whispering thing got annoying. Heath (where’s my posthumous Oscar) Ledger does a great turn as the Joker, and demonstrated that his acting ability will indeed be missed. Would he get my vote for the Oscar? No. Why? Simple, the standout performance in this film - for me - was given by Gary Oldman.
10. Cloverfield - I’m including this because I actually expected to hate it, and for about the first 15 minutes or so of the film I still thought that. But then what follows is around an hour of good old fashioned monster movie silliness, that I thoroughly enjoyed.

Worst Film
Indiana Jones and the Lost Franchise (or whatever it was called). This was woeful.

Albums of the Year

This was quite hard, as outside of the top half dozen or so there were a lot of good solid records that could have made up the numbers.

Also there were several albums that may well belong on the list but, I just have not given a good enough listen too to include, so, sorry: Elbow, Glasvegas, Kings of Leon, Amanda Palmer and others.

So, the question is, was there one album that stood out from the crowd? For me, yes, and for the second year running it came from Nick Cave. Dig Lazarus Dig continued a rich vein of form that Nick has been mining for the past few years, and so was the record I have returned to most often in 2008.

1. Nick Cave and the Bad Seeds - Dig! Lazarus Dig!!: - From the opening bars of the title track this is a wonderful record.
2. The Hold Steady - Stay Positive : Some people have were not as keen on this album as they were with Boys & Girls in America. It was true that this album was less of a progression than they had made musically on previous records, but it worked for me, with the band delivering a handful of the best things they’ve written to date in the guise of: ‘Slapped Actress’, ‘One for the Cutters’, and ‘Sequestered in Memphis’. [New stuff also sounded great live]
3. Todd Rundgren - Arena: Despite my better judgement this came very close to actually being my album of the year. It is like a mini greatest hits package, but without the need for the albums that the tracks needed to be on first.
4. Fleet Foxes - Fleet Foxes: The US and UK critics have been falling all over themselves about the Fleet Foxes. If they weren’t talking about MGMT (and most were) then they were talking about this folkie throw back harnessing Beach Boys harmonies mixed in with a Little CSNY and more. Hard after a few listens not to be pulled in.
5. Laura Marling - Alas I cannot Swim: Yes, is does sound like it was written by a young girl, and a bit twee in places, but that is actually part of the charm of this album. Duffy and Adele may have gotten most of the coverage, but Marling was the one that won me over. Potentially a huge talent.
6.Metallica - Death Magnetic: Oh yes indeed. Turn those guitars up to 10. A True monster of an album, and containing a host of great tracks, such as: Cyanide; The Day that Never Comes; Judas Kiss; and Unforgiven III. A true return to form.
7. Nine Inch Nails - The Slip: The best free album of the year. Not something that was ever going to convert you to the NIN cause, if you were not already a fan, but a pretty strong offering all the same.
8. Teddy Thompson - A Piece of What You Need: Third album from Teddy, and after time out for an album of country covers it was back to the kind of wonderful folk/country tinged pop that made his debut album such a delight. Like father Richard, the boy knows how to craft a catchy tune.
9.The Gutter Twins - Saturnalia: Idle Hands is possibily my favourite track of the year. Whilst the rest of the album cannot quite live up to that, it remains a very good rock record.
10. Sons & Daughters - This Gift: My favourite record out of Scotland this year. A very underrated band, and album.
11. Gemma Hayes - The Hollow of Morning: Big fan of Gemma (and she was great at Union Chapel)This was an assured record, full of wonderful songs.
12. Thea Gilmore - Liejacker: Another fantastic songwriter. More stripped down than she had been for a while, but still great stuff, and a cracking cover of You Spin Me Right Round.
13. Motorhead - Motorizer : No, really, I am serious. I would not have expected to say so, but this is a really great album. There is no re-invention of the wheel going on or anything - it sounds exactly like a motorhead album, but tracks like Runaround Man, and English Rose, were their best in years.
14. Rick Springfield - Venus in Overdrive: Over produced to within an inch of its life, but I have always been a sucker for Rick. During the late eighties, early nineties this man was the definition of what pop/rock was. Anyway, this was a bit of a return to form.
15. Ingrid Michaelson - Be OK : This isn’t really a proper album as such, but a collection of previously unreleased songs, demos, covers and live recordings (A portion of the proceeds go to Stand Up To Cancer) But it was still a great collection, and reminded me why she deserves to be better known that she is.
16. Bon Iver - For Emma, Forever Ago: Like Fleet Foxes, this came from nowhere and showed that folk-type music was still cool.
17. The Fireman - Electric Arguments: Paul McCartney released his best solo album in years last year, and followed it up with his third outing as The Fireman, and surprisingly good it was too.
18. Camille - Music Hole: Ever so slightly mad, but with an outstanding voice and the ability to write a song that includes meowing that transcends the stupid.
19. Duffy - Rockferry: I tried to resist the charms of Duffy, but eventually she wore me down, and I had to admit I really liked like record.
20. Bob Mould - District Line: A return to the kind of material that made Sugar such a great band - just check out songs like: The Silence Between Us.
21. The Cure - 4:13 Dream : He’s still not the happiest bunny, and still cannot apply make-up, but I was pleasantly surprised by what is the best Cure album in years. Although the Duran Duran impersonation on Bond Theme attempt, Sleep when I’m Dead, I could live without.
22. The Knees - Sexual Radio: It was a toss up between this and the Be Your Own Pet album for a spot in the top 25, but The Knees get it, with an album that makes me smile when I listed to it. Can’t say better than that really.
23. REM - Accelerate: Kept it short and it worked. Very much a back to basics album for REM and it reminded me what a fine band they are still capable of being.
24. Ladyhawke - Ladyhawke: Again, it was a bit of a toss up between this and The Killer’s album. Both are snyth-pop records, and both did nothing for me on first listen. However both have slowly worked there way into my mind over the past month or so. I choose Ladyhawke in the end because, it sounds fresher, and because Sam’s Town is still a better Killers album.
25. Ryan Adams & The Cardinals: Not vintage Adams by any stretch but still a strong record.

Honourable mentions: Aimee Mann - Smilers ; and Mary Chapin Carpenter: Come Darkness, Come Light. {V Good Xmas album, as funny enough was Aimee’s one from last year}

The Birds and the Bees - An English lesson

So, there I was sitting eating my lunch - a Cajun chicken baguette (thanks for asking) when I started wondering about the birds and the bees. Thankfully, I also came to some conclusions, which I will share with you all now.

Mock Duck : An instruction. Find a pond and get mocking.
Pigeon English: Used to describe someone English who uses the word coo a lot and shits on you from a great height.
Big Bird: Woman who is of a large size and bright yellow coloured.
A Bee: The first two letters of the alphabet.
A bird in the hand is worth two in the bush: - Useful information for trading in Australia
Happy as a duck in water: - Tried this one at home and the Duck didn’t seem too happy when the water started boiling. On the plus side it was a nice soup.
Loose as a goose: As in ‘there’s a goose loose around this hoose’ one presumes. Often people make the mistake of thinking this was a mouse. They’re wrong. Get over it.
No spring chicken: Information informing you that the dish is off the menu at a restaurant.
Tastes just like Chicken: Yes, that’s because it’s chicken.
Chickens come home to roost: As opposed to booking a room at a Spa or a Hotel? It’s where they live, of course they’re going to come home.
Birds of a Feather: Sitcom.

Rouken Glen Park

A bit of a different post from me today - yes, no rss feeds from Andorra or the like. Calm yourselves.

Anyway, an old school friend’s children - Mia & Sam - entered a competition to write about fun places to go in Scotland and their entry about their local park, Rouken Glen Park has been shortlisted for the final. Their school will pocket £5000 if they win, and as Eaglesham is a wee village (they need the cash), they need to muster some support from far and wide, so I have pledged to do my bit by bigging them up on my blog.

The CAT’s whiskers

The Competition Appeal Tribunal (CAT) has re-launched its website. [For those outside of the UK, the CAT is a specialist judicial body whose function is to hear and decide cases involving competition or economic regulatory issues.] The old version of the site was hit by a javascript malware infection in May/June, which caused the site to be down for over a month before a bare bones site re-appeared with the latest judgments. The re-launched site comes with a nice new look. It is very clean, organised, and easy to navigate and use. Unlike the PhonepayPlus site, which I was/am not a fan of, this is excellent. Well done all at the CAT. There are some new features launched with the new site, which are well worth mentioning:

 1) The ability to conduct keyword searching within all documents on the website by means of the search box in the top right-hand corner of each page.

 2) Additionally, if you are searching within Judgments you can also narrow you search by the use of a selection of Keywords, divided into Procedural, Competition, and Communication.

    Ruling of the Tribunal setting out its reasons for (i) refusing Sky’s application for permission to appeal from the Tribunal’s judgment of 29 September 2008 ([2008] CAT 25), and (ii) refusing Virgin Media’s application for permission to appeal from the Tribunal’s judgment of 30 October 2008 ([2008] CAT 32). Both Sky’s and Virgin Media’s applications were refused on the basis that the grounds of appeal raised had no real prospect of success and there were no other compelling reasons to allow the appeals to go forward.

    I’d personally prefer a little bit more detail in the summary, but this is still a nice addition to the functionality and helpfulness of the site.

    Andy & Charlie show tells music industry what they want to hear

    Andy Burnham seems to have been finally hooked by the Music Industry and now wants to support calls for extending the term of protection for recorded performances from 50 years. At the moment he is still stopping short of the EU’s proposal to extend it to 95 years, instead calling for “An extension to match more closely a performer’s expected lifetime, perhaps something like 70 years, for example, given that most people make their best work in their 20s and 30s”.

    The justification for this?

    “There is a moral case for performers benefiting from their work throughout their entire lifetime … It’s only right that someone who created or contributed to something of real value gets to benefit for the full course of their life.”

    I’m sorry? It’s only right? Why?

    I’m really sorry, but if you are going to go down this road then computer programmers, book printers, and house builders, and more should be added into a widened protection. It really does make as much sense to include them if this the rationale behind it. No, silly, it’s all about copyright.

    “the legal concept of copyright has underpinned our creative industries for decades, and is essential to rewarding talent and creativity”

    Let me say, once again, these rights were granted to act as an incentive to produce new recordings by allowing those producing the sound recordings a reasonable period to recoup their investment. These rights are economic not moral - unlike the case of songwriters/authors who get longer protection (life of the author plus 70 years). The temporary monopoly granted in the form of such a protection to sound recordings is a valid one, but this has to be balanced with benefits to society, which means the right should be limited to allow the producers of the sound recording a reasonable time to recoup the cost of producing the recording. If a record is going to make back its money it will usually do so quite quickly. The protection is not there to compensate producers for records that never recoup the cost of producing them.

    Commenting on Andy Burnham’s decision to support the extension of copyright for sound recordings, Liberal Democrat Shadow Culture, Media and Sport Secretary, Don Foster thinks it is Christmas stating that: “This is a long overdue U-turn. The Government has finally woken up to the financial difficulties many of our musicians are facing.Ministers must now seek to implement the European Commission’s proposals as a matter of urgency.” I’m sure there is an equally pointless response from the tory front bench too.

    Burnham was speaking at the UK music Creator’s Conference. Charlie McCreevy - the man behind the EU’s proposals - was also there. And our Charlie had some harsh words for our UK academics (who did things like doing economic analysis of the proposals): “There are a lot of academics here in the UK who engage in general considerations on the length of copyright. But what they seem to be neglecting in their deliberations is that we are talking about real people here, not abstract concepts. It’s pretty straightforward where I am coming from – and that’s about as far away from an academic ivory tower as you can get. We are talking about livelihoods and payment for work rendered.”

    I don’t know about you, but my tear ducts are filling up again.

    And he’s right. He said ” We are talking about livelihoods and payment for work rendered.” Can not argue with that, and guess what Charlie, the performers have been paid for the service rendered. If they were a session musician they will have got paid their fee; if they were the performer they would have almost certainly signed over their rights to the record label. In both cases they have still been paid for the work rendered, and if there are any problems it once again comes back to the contracts they signed, nothing else.

    I presume Charlie is talking about people such as those at The Centre for Intellectual Property and Information Law at Cambridge University that assessed the economic evidence for the case for an extension of the copyright term in sound recordings for the Gower Report on IP and found the case “to be weak.” Also, this bunch of trouble makers that had to twist the arms of some of their fellow ivory tower dwellers across Europe, such as Professor P. Bernt Hugenholtz, of the Institute for Information Law who produced two major studies for the EU on copyright published in 2006 and 2007. ( Some of this work made it into this article that I have linked to before) who also concluded that a copyright term extension would be a bad idea.

    Charlie also welcomes the proposed amendment to include film actors into the extension. Can my Mom be added in too?

    Some people argue that the idea of the so-called session musician fund in the proposals makes it all worthwhile. Fine, I have no problem with that proposal, and there is absolutely no reason why it cannot be done within the current legal and contractual framework. It wont be, but it could be.

    I actually have the solution. Let’s just make copyright (and related rights - as that is what we are actually talking about in this instance) last forever. Problem solved.

    Norwegian government departments with rss feeds [ALL of them!]

    It had to happen one day, and today is that day. My (pointless?) quest to create lists of rss feeds offered by government departments around the world (or Europe, at least) has at last found a winner. Take a bow Norway, who offer feed for EVERY single government department.

    The Norwegians have one government portal, with each government department/ministry having its own mini web/section as part of that portal. It looks good; it is easy to navigate around; and why aren’t other countries doing this?? They have News and/or Press Release feeds in English too for every site - except for the Ministry of Culture and Church Affairs. If anyone reading from that ministry can let me know why you don’t want to play, I’d be interested to hear from you, as it is the one thing that spoils what would have been a perfect 10.
